Compass Sues CRMLS and Pledges to Pay Agent Fines in Listings Fight
How South Bay homes can be marketed outside the MLS is now the subject of competing federal lawsuits. Compass filed a federal antitrust lawsuit against California Regional Multiple Listing Service (CRMLS) on Friday, Oct. 16, and pledged to cover qualifying agent fines, according to a WRE News report by John G. Stevens published Oct. 17, 2026.
Compass contends CRMLS restrictions unlawfully limit how homeowners and brokers market properties. It says agents can face fines of up to $2,500 for certain public marketing outside the MLS. The report stresses the allegations remain contested and no court has ruled that the challenged rules violate antitrust law.
The reimbursement pledge is specific. It covers agents affiliated with Compass's company-owned Compass, Coldwell Banker Realty and Sotheby's International Realty brokerages. To qualify, agents must submit the fine notice and assign their related right to sue CRMLS to Compass. The report notes this is a company commitment, not a court-ordered protection against MLS discipline.
CRMLS disputes the premise. The case escalates a confrontation already in another federal court: on Oct. 5 CRMLS sued Compass in New York, asking a judge to declare its cooperation rules lawful. CRMLS has argued that requiring cooperation prevents brokerages from benefiting from shared listing data while withholding their own publicly marketed inventory, and its Rule 7.9 explanation says sellers can authorize public marketing outside the cooperative system while distinguishing that option from retaining the MLS's cooperative benefits.
Compass seeks injunctive relief and damages, while CRMLS's earlier case seeks a declaration that its rules comply with federal and state antitrust law. For South Bay buyers and sellers, nothing changes today in how a listing is entered, but the outcome could affect how widely some homes are marketed before - or instead of - appearing in CRMLS, which is the MLS serving Torrance and much of the South Bay.
